Legal documents translations

Numerous organizations need legal documents translating. This is often a very complex task. Even minor errors in the translation can result in potential lawsuits and legal exposure, consuming time and money and putting hard won reputations at risk.

The legal language of a text or document is significantly influenced by the culture of the country and the structure of the legal system. The incongruence of two legal systems a translation involves constitutes one of the key challenges in translating a legal document. Certain concepts can be phrased entirely differently among two countries, and therefore a deep knowledge of both legal systems and their terminologies ensures accurate translations.

Matters of legal significance are usually confidential, and so, a legal translator should be of credible standing and is expected to maintain client confidentiality.
The importance of precise legal translation is becoming more vital than ever, especially when dealing with complex situation such as; finalizing a business overseas, court interpreting, medical research, and other legal situations.

Translating legal documents is one of the most challenging in professional translation services because each country has its own specific legal system and terminology that must be accurately rendered in the target language. It is not enough simply to be proficient in two languages to do specialized legal translations: It requires a deep knowledge of the respective legal systems and years of study and practice.

Ideally, different legal documents should be translated by legal translators who have experience in specific types of documents. When the need for the translation of legal documents arises, there is simply no room for error: The smallest mistake could have serious consequences.

Legal terminologies of the source and target languages often vary widely. This is the standard difficulty faced by legal translators. They must ensure that the terminology used in the translation matches its true meaning in the legal context.

The legal language and law of a country reflect its culture. The legal translator must understand the cultural differences of the legal systems of the two societies. In other words, the level of difficulty in a legal translation depends entirely on the level of similarity between the legal systems of the source and target languages.

Traduzioni giurate in tedesco non sono altro che traduzioni asseverate di un testo italiano. Il traduttore porta quindi in Tribunale il testo in originale pinzato alla traduzione e al verbale di asseverazione. Pinzato per modo di dire – per una chiamata in causa per esempio di 50 pagine, quindi un atto di 100 pagine, conviene far effettuare prima una rilegatura termica. Il traduttore giura poi davanti al cancelliere “di aver bene e fedelmente adempiuto all’incarico affidatomi al solo scopo di far conoscere la verità”.

La traduzione giurata prevede quindi il giuramento e la firma del traduttore e del cancelliere. Inoltre devono essere applicate; almeno questo è la prassi applicata dal Tribunale di Savona; marche da bollo da 16,00 € ogni quattro pagine della traduzione, incluso il verbale di asseverazione. Ci sono Tribunali che vogliono anche la marca da bollo da 16,00 € separata per il verbale di giuramento.

Quando servono le traduzioni giurate in tedesco?

Per le notifiche di atti di citazioni, sentenze, decreti ingiuntivi ecc. p.es. in Germania ci sono cancellerie che vogliono comunque avere una traduzione giurata, ci sono cancellerie e avvocati che notificano la traduzione semplice e ci sono cancellerie che vogliono una semplice dichiarazione firmata dal traduttore che attesti che la traduzione sia fedele al testo in lingua originale. Conviene quindi informarsi bene prima su che cosa è richiesto. Infine c’è da considerare anche il fattore tempo.

La traduzione giurata in tedesco deve essere fatta davanti ad un cancelliere e quindi devono essere rispettati gli orari delle cancellerie. In tanti Tribunali le traduzioni giurate possono essere fatte solo tre giorni alla settimana e solo nelle due ore in cui vi è un cancelliere a disposizione.
